Terms of Service

Eligibility and your account

• You must be at least 16 years old and able to form a binding contract to use the Services.
• You are responsible for all activity under your account and for keeping your credentials secure. Notify us promptly at [email protected] of any unauthorized use.
• If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
• You must provide accurate information and keep it up to date.

The Services

AI Emaily is an AI-native email client with an autonomous assistant that triages, drafts in your voice, schedules, and closes loops across connected mailboxes. The assistant operates at the authority you choose:

• Manual — the agent suggests; you do everything.
• Copilot — the agent drafts and proposes actions, and a human approves before anything is sent.
• Autopilot — the agent acts within the rules you configure, with undo and a full audit trail.

We may add, change, or remove features over time. Some features are offered across some but not all platforms, and availability may differ by region.

Your content

"Your Content" means the email, attachments, drafts, contacts, calendar data, and other materials you connect or create through the Services. You retain all rights to Your Content. You grant us a limited, worldwide, non-exclusive license to host, process, transmit, and display Your Content solely to operate and provide the Services to you, including running the AI features and the agent within the authority you set. We do not use Your Content to train generalized AI models, and we do not sell it. See our Privacy Policy for details.

AI features and the autonomous agent

• AI-generated summaries, drafts, and actions are provided to assist you and may be inaccurate, incomplete, or unsuitable. You are responsible for reviewing AI output before relying on or sending it. We do not warrant the accuracy of generated content.
• In Copilot, no message is sent without human approval. In Autopilot, the agent acts only within the boundaries, allow-lists, and confidence thresholds you configure — and you remain responsible for messages and actions taken from your account, including those the agent performs on your behalf.
• You can pause the agent at any time (kill switch), undo recent actions within the provided window, and review the audit trail.

Connected third-party accounts

To use the Services you may connect third-party accounts such as Gmail, Microsoft Outlook/365, or other IMAP/SMTP mailboxes, and optionally Slack, Telegram, or Discord. You authorize us to access those accounts to provide the Services, and your use of them remains subject to the third party's terms. We are not responsible for third-party services, and they may change or restrict their APIs in ways that affect the Services. You can disconnect any account at any time.

Acceptable use

You agree not to:

• send spam or bulk unsolicited messages, or violate anti-spam, telemarketing, or email-marketing laws;
• infringe intellectual-property, privacy, or other rights, or transmit unlawful, harmful, or deceptive content;
• attempt to gain unauthorized access to, disrupt, reverse-engineer, or probe the Services or their security;
• use the Services to build a competing product, or scrape or resell them without our written permission;
• circumvent usage limits, AI credits, rate limits, or access controls;
• use the Services in violation of applicable law or any third party's terms.

You are solely responsible for the messages sent from, and actions taken through, your account.

Plans, billing, and trials

• Free tier & credits. We offer a free tier with limited AI credits. Credits and limits may change; unused credits do not roll over unless stated.
• Paid plans. Paid plans are billed in advance, monthly or annually, through our payment processor. By subscribing you authorize recurring charges until you cancel.
• 14-day money-back guarantee. Paid plans (subscription and lifetime) include a 14-day money-back guarantee: request a refund within 14 days of your purchase and we will return it in full.
• Renewals & cancellation. Subscriptions renew automatically. You may cancel anytime and retain access through the end of the current billing period; outside the 14-day guarantee we do not provide prorated refunds except where required by law.
• App-store purchases. Purchases made through the Apple App Store or Google Play are billed by and managed through that store, subject to its rules and refund policies.
• Taxes & changes. Prices exclude taxes, which we add where applicable. We may change prices with notice; changes take effect at your next billing cycle.
• Lifetime / promotional codes. Lifetime, AppSumo, or other promotional offers are subject to their specific terms and fair-use limits.

Beta and pre-release features

We may offer features, platforms, or apps labeled beta, preview, or "coming soon" (for example, on macOS, iOS, Android, or desktop as they roll out). These are provided "as is," may be changed or discontinued, and may be less reliable than generally available features.

Intellectual property

The Services, including all software, design, branding, and content we provide (excluding Your Content), are owned by AI Emaily or our licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose. All rights not expressly granted are reserved. "AI Emaily," "Autopilot," "Copilot," and our logos are our marks.

Feedback

If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it to improve the Services, without obligation to you.

App-store terms

If you obtain an application through the Apple App Store or Google Play, you also agree to that store's terms, and the following apply where required:

• Apple: these Terms are between you and AI Emaily, not Apple; Apple is not responsible for the app or its support, but is a third-party beneficiary entitled to enforce these Terms against you. You confirm you are not located in a U.S.-embargoed country or on a prohibited-parties list.
• Google: your use of Android apps is also subject to the Google Play Terms of Service.

Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that AI output will be accurate.

Limitation of liability

To the maximum extent permitted by law, AI Emaily and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to your use of the Services. Our total liability for any claim is limited to the greater of the amounts you paid us in the 12 months before the event giving rise to the claim, or USD 100. Some jurisdictions do not allow these limits, so they may not fully apply to you.

Indemnification

You agree to indemnify and hold AI Emaily harmless from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

Suspension and termination

You may close your account at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or fail to pay. Before deletion you can export Your Content from the app; after termination we delete or anonymize your data as described in the Privacy Policy. Sections that by their nature should survive (ownership, disclaimers, liability, indemnity, governing law) survive termination.

Changes to these Terms or the Services

We may update these Terms from time to time. For material changes we will provide notice (such as in-app or by email) and update the "Last updated" date above. Continued use after changes take effect means you accept the revised Terms. We may also modify or discontinue parts of the Services.

Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which AI Emaily's operating entity is established, without regard to its conflict-of-laws rules. You agree to first try to resolve any dispute informally by contacting us. Where permitted, disputes will be resolved in the courts of that jurisdiction; nothing here limits any non-waivable rights you have under the mandatory laws of your country of residence.

General

These Terms and the Privacy Policy are the entire agreement between you and AI Emaily regarding the Services. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
